“91-Year-Old Woman Faces Eviction, Wins Tribunal Victory”

A 91-year-old woman residing in a seniors’ apartment building in Windsor, Ontario, has received an eviction notice, but her celebration ensued after a tribunal deemed the notice as “defective.” Sylvia Berk, expressing relief and gratitude, navigated through a lengthy process before the Landlord and Tenant Board.

Berk is part of a group of tenants at the I.L. Peretz House facing significant rent hikes, stirring a conflict between residents on fixed incomes and the landlord citing rising costs to justify the increases. Ghadeer Jwad, representing the tenants, emphasized the broader impact of the issue beyond Berk’s individual case.

Living in the building for over ten years, Berk benefited from subsidies that maintained her rent at approximately $450 monthly, a figure that soared to $700 last year, a 50% surge. Despite the increase still being below market rates, Berk struggled to meet the new amount, prompting the eviction notice.

The Windsor Jewish Federation, managing the property, argued that the building’s status as a designated housing project exempted it from regular regulations limiting rent hikes to 2.5%. However, the Board’s decision highlighted the landlord’s failure to provide evidence to support this exemption, deeming the eviction notice invalid.

While the landlord had the opportunity to rectify the situation by seeking arrears based on the 2.5% limit, no action has been taken yet. Other tenants are also challenging rent increases, with future hearings scheduled. Jwad acknowledged the landlord’s operational challenges but emphasized the need for consistency in rental rates set by the landlord.

Sylvia Berk remains optimistic about the outcome of the situation, offering words of encouragement to fellow tenants experiencing distress. She emphasized faith and resilience, expressing hope for a positive resolution that would make rent affordable for all residents in the building.
