“Former Alaska Airlines Pilot Spared Prison for In-Flight Tampering”

An ex-Alaska Airlines pilot who attempted to disable a passenger jet’s engines has been spared from imprisonment after expressing gratitude towards the flight crew for intervening.

Joseph Emerson, a former Alaska Airlines pilot, was off-duty and occupying an extra seat in the cockpit during a Horizon Air flight from Everett, Washington, to San Francisco on October 22, 2023, when he tried to tamper with the engines. The flight crew managed to restrain him, averting a potential disaster, and the plane was diverted to Portland, where it landed safely with over 80 passengers on board.

In a court hearing in Portland, Oregon, US District Court Judge Amy Baggio sentenced Emerson to time already served and three years of supervised release. Prosecutors had requested a one-year prison term, while his defense team had sought probation. Judge Baggio acknowledged the human fallibility of pilots, stating that everyone requires assistance at times.

Following his arrest, Emerson disclosed to the police that he was distressed by a friend’s recent death, had consumed psychedelic mushrooms two days prior, and had been awake for over 40 hours. He claimed he thought he was dreaming and was attempting to rouse himself by manipulating the plane’s fire suppression system and fuel supply.

Before receiving the sentence, Emerson expressed remorse for the harm caused, acknowledging his responsibility for the incident. He emphasized personal growth resulting from the experience and was visibly emotional upon being released by the judge, acknowledging the lessons learned from the ordeal.

Emerson had previously entered guilty or no-contest pleas to all charges in agreements with state and federal prosecutors. He faced federal charges for interfering with a flight crew and state charges in Oregon for endangering others and an aircraft. He had been released from custody with conditions including mental health treatment, abstinence from drugs and alcohol, and avoidance of aircraft pending trial.

The court mandated 50 days in jail, five years of probation, 664 hours of community service, and substantial restitution to Alaska Air Group. Half of the community service can be completed at a pilot health nonprofit Emerson established after the incident. Additionally, he must undergo assessments for substance abuse and mental health, refrain from unauthorized drug use, and maintain a distance from operable aircraft without permission.

Federal prosecutors underscored the heroic actions of the flight crew in preventing potential casualties during the incident. Emerson expressed gratitude for the crew’s intervention, recognizing the impact on his life and vowing to address mental health issues and substance dependence.

The airline affirmed that there were no apparent signs of impairment in Emerson before the incident, prompting a reevaluation of cockpit safety protocols and the mental fitness requirements for cockpit access.
