    “1937 Child Marriage in Tennessee Sparks Legal Change”

    A marriage that shocked the nation and spurred legal changes occurred between a 22-year-old farmer, Charlie Johns, and a nine-year-old girl, Eunice Winstead, in rural Tennessee on January 19, 1937. Despite widespread condemnation, the marriage was technically legal due to the absence of a minimum marriage age law at the time.

    Johns paid a dollar to Baptist preacher Walter Lamb to officiate the ceremony, while Winstead misled her parents by claiming she was going to buy a doll. By misrepresenting Winstead’s age to acquire a marriage license, Johns managed to marry her, although the community later discovered her true age of nine. Records revealed that Winstead’s mother had also married young at 16, and her sister at just 13.

    Martha Winstead, Eunice’s mother, eventually approved of the marriage due to Johns’ property ownership and reputation as a skilled farmer with 50 acres of land and livestock. Despite the controversy, Martha defended the marriage, emphasizing the importance of love in relationships.

    Following national media coverage and public outrage, Tennessee swiftly enacted a law later in 1937 setting the minimum marriage age at 16 with a waiting period for girls under 18. Despite the backlash, the couple remained married for many years.

    Eunice briefly attended elementary school in the summer of 1937 but left due to disciplinary issues after a few days. The couple resided with Johns’ parents in Sneedville for several years, where Eunice gave birth to their first child at the age of 14 in December 1942. They went on to have eight more children together.

    Despite their enduring marriage, Johns expressed anger when their 17-year-old daughter Evelyn married a 20-year-old man, claiming her age had been misrepresented for the marriage license. The couple remained married for over six decades until Johns passed away in February 1997, followed by Eunice in August 2006.
